PENGATURAN SISTEM ORGANISASI ADVOKAT DALAM RANCANGAN UNDANG-UNDANG TENTANG PERUBAHAN UNDANG-UNDANG NOMOR 18 TAHUN 2003 TENTANG ADVOKAT

Abstract

Advocate profession has a close relation with advocate organization as their safe haven. A single bar association system adopted by the Indonesian Law on advocate produces various problems i.e. on the legality of the instalation and oath of advocate candidates. These problems sholud be addressed by amending the existing law on, including introducing a stiffer regulation on freedom to create advocate association. The writer says that the introduction of organization system of a federation of bar association can be best option in Indonesia for the reason that this system accommodate freedom of association and assemble guaranteed in the state constitution. This can also contribute to the creation of National Advocate Council as a solution to the currently conflict amongs to different advocate organizations. As a consequence, the writer argues that there is urgency to immediately pass the amending law to give law certainty for advocate profession and, eventulaly, for justice seekers.
